RELEASE AND WAIVER OF LIABILITY

NOTE: YOU HAVE THE RIGHT TO CONSULT WITH AN ATTORNEY BEFORE SIGNING THIS DOCUMENT. THE USE OF FIREARMS IS DANGEROUS.

I hereby assume all risks for participation in gun range activity by agreeing to the following:

That I am voluntarily participating in activities at the indoor gun range located at 98 Purrysburg Rd., Hardeeville, SC 29927, operated by Tactical Defensive Solutions LLC, doing business as Lowcountry Guns and Range, formerly known as Palmetto Indoor Range and Sporting Goods LLC. The building in which the range is located is owned by Franklin 98 LLC. This waiver applies to Tactical Defensive Solutions LLC, Lowcountry Guns and Range, Franklin 98 LLC, and their respective legal representatives.

I understand the risks and hazards involved, and I recognize serious and life-threatening injuries can occur while carrying or using a firearm, participating in class, or later from the materials presented, whether caused by the passive or active negligence of the aforementioned parties or myself. Pertaining to all counties in South Carolina, Lowcountry Guns and Range and its entities or otherwise.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in gun range activities. I represent that I am physically fit and I have no medical, psychological, or any other condition, which would prevent my full participation in shooting at a gun range.

I realize that liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them or because of their possible liability without fault.

In consideration of being permitted to participate in the activities of the gun range, I agree to assume full responsibility for any and all risks, injuries, or damages, known or unknown, which I might incur as a result of participating in activities at the gun range.

In further consideration of being permitted to participate in activities at this gun range, I, my legal heirs, executors, administrators, next of kin, successors, or legal representatives knowingly, voluntarily, and expressly waive, release, discharge, hold harmless and promise to indemnify forever and covenant not to sue any of the following: Tactical Defensive Solutions LLC, Lowcountry Guns and Range, Franklin 98 LLC, Tactical Defensive Solutions LLC doing business as Lowcountry Guns and Range, Alexander Rossi, Frank Rossi, or their representatives, successors and assigns, and Franklin 98 LLC operating at 98 Purrysburg, Rd. Hardeeville, SC 29927; their agents, facilities owner, officers, director, shareholders, employees, instructors, volunteers, or representatives from any and all injuries or damages of whatsoever kind and nature that I may sustain as a result of participating at the gun range, in any firearms training class, or of direct or indirect use of the gun range waiting area, any of its classes and on the property. By signing this waiver, I am giving up my right to sue the parties named above for any injury, death, or damages arising from my participation, to the fullest extent permitted by South Carolina law. I understand that this type of activity at a gun range may result in minor injuries such as bruises and lacerations.

I certify that I am over the age of 18 years old and I am legally entitled to own or use a handgun and/or firearm. All minors must be accompanied and supervised by an adult 18 years or older. I certify that I am either an adult, 18 years or older, or I am accompanied by and supervised by an adult.

I agree that any provisions of this release are held to be invalid, nevertheless, the balance of the release shall continue in full force and effect.

I agree that if the gun range operator, manager or instructor believes that I am or will be involved in criminal activity, the instructor will expel me from the class and or range with no refund. I also agree that the parties covered in this waiver are not liable for slander and/or libel as part of being expelled.

I agree that if the gun range employees believe that I am or will be unsafe or dangerous, the employees or instructors will expel me from the gun range with no refund. I also agree that the parties covered in this waiver are not liable for slander and/or libel as part of being expelled.

I agree to comply with all range safety rules and the directions of range safety officers, instructors, and employees at all times, including all rules regarding eye and ear protection, muzzle and trigger discipline, and firearm handling. I understand that failure to follow range rules or staff instructions may result in immediate expulsion with no refund.

By using the range, I represent and agree that I have received, read, and understand the range rules posted at the facility and provided by staff, and that I understand the safe operation and handling of the firearm(s) I will use. I agree that I am solely responsible for operating my firearm safely and in accordance with those rules and all applicable laws. I acknowledge that bullets are to be directed only into the designated bullet trap, and I agree that if I cause any damage to the range, including striking, hitting, or damaging any part of the range other than the bullet trap, whether by negligence, unsafe handling, or violation of range rules, I will be subject to financial penalties and will be financially responsible for the full cost of all resulting repair or replacement.

I agree that I am financially responsible for any damage I cause to the facility, range equipment, fixtures, target systems, or any rental firearm or equipment, whether through negligence, misuse, or violation of range rules, and I agree to reimburse Lowcountry Guns and Range for the full cost of repair or replacement.

I understand that I am responsible for using only ammunition and firearms approved by range staff, and I agree to bring only ammunition that is appropriate for the equipment and backstop in use. I acknowledge that lead exposure, noise, and flying debris, including ricochet and fragments, are inherent risks of firearm use, and I assume those risks knowingly and voluntarily.

I certify that I am not under the influence of alcohol, illegal drugs, or any medication that would impair my ability to safely handle a firearm, and that I am not otherwise prohibited by federal or South Carolina law from purchasing, possessing, or using a firearm or ammunition.

This release shall be governed by and construed in accordance with the laws of the State of South Carolina, and any dispute arising from this release shall be brought exclusively in the state or federal courts located in Jasper County, South Carolina.

I understand that photos and video may be taken during your visit at the gun range and agree that my image may be used for advertising and that extreme close up frontal facial angles and full legal names will not be published without prior approval. This document gives us permission to communicate with you via email and text message.

I understand that I must sign this release of liability and fully comprehend the structure and nature of the class, and also the risks involved before being allowed to participate in gun range activities. I have read the above release and waiver of liability and fully understand its contents. I have been informed of all risks involved and I voluntarily agree to the terms and conditions stated above. I understand that by signing below, I am voluntarily giving up my right to sue and my right to a jury trial against the released parties for any claim covered by this release.

The aforementioned documents constitute the entire Release and Waiver of Liability. Any Instructor, range safety officer or employee WILL NOT provide legal advice or opinion. No staff member, volunteer or any representative of the aforementioned gun range does NOT represent any Law Enforcement Agency. We reserve the right to contact you regarding marketing emails and promotions.

ACKNOWLEDGMENT AND SIGNATURE

I have read this entire Release and Waiver of Liability, I understand it, and I voluntarily agree to be legally bound by it.

Completing this electronic form and entering my name above constitutes my electronic signature and acceptance of the above terms, and has the same legal effect as a handwritten signature.
